Generative AI Service Terms of Use

Article 1 (Purpose)

These Terms of Use are intended to define the rights, obligations, and responsibilities between INUSCOMMUNITY Co., Ltd. (hereinafter "Company") and users regarding the use of generative AI services provided by the Company. The user's use of the service is conditional upon acceptance and compliance with these Terms and all applicable laws, including export restriction laws.

Article 5 (Service Data Collection and Use)

The Company may collect, store, and use service data including inputs entered by users during service use for the purpose of providing better services and improving service quality. Some features of the Service may transmit and store service data including inputs to servers of the Company or its agents.

Article 6 (Input Restrictions)

Users must ensure that inputs do not contain the following. If violated, the Company may take measures such as deleting inputs and restricting use.

• Personal information of others, including sensitive information and unique identification information
• Secrets or trade secrets of others
• Content that infringes on intellectual property rights such as copyrights of others
• Content that defames or invades the privacy of others
• Content that violates laws or social norms

Article 6-2 (Rights in Inputs and Verification)

Users must comply with the following regarding inputs they enter or upload to the Service (including images, videos, and voice):

• Users must hold, or have lawful permission from the rights holder for, all rights needed to use their inputs, including copyrights, portrait rights, rights of publicity, and rights in a person's voice.
• Inputs containing a real person's face, likeness, or voice may be used only with that person's explicit consent (or, for a minor, the consent of a legal guardian). Users must not create outputs that depict or impersonate a specific person without consent.
• If the Company considers it necessary to verify rights, it may ask users to submit materials showing that they hold the rights or have the depicted person's consent, and users must cooperate.
• To verify rights and handle disputes, the Company may retain submitted materials and related inputs and generation records for the period set by applicable law and the Privacy Policy.
• If rights or consent cannot be confirmed, or if a rights infringement report is received, the Company may refuse to process the input, delete the input and outputs, and restrict use of the Service.
• Third-party AI models connected to the Service may reject inputs containing real people under their own policies, and using materials of real people may require identity verification and approval procedures set by those providers.
• If a dispute with a third party arises from inputs provided by a user or from the use of outputs, the user must resolve it at their own responsibility and cost, and must compensate the Company for any resulting damage.

Article 7 (Prohibited Activities)

Users must not use the Service for illegal purposes or methods contrary to these Terms or applicable laws, and must refrain from the following activities:

• Acts that interfere with or bypass Service functions
• Transmitting or distributing malware, viruses, etc.
• Accessing or damaging the Service without authorization
• Creating or transmitting spam, mass messages, advertisements, etc.
• Reverse engineering or disassembling the source code of the Service
• Copying, modifying, or creating derivative works of the Service
• Selling, reselling, or transferring licenses of the Service
• Using the Service for professional advice on medical, legal, financial matters, etc. (provided for informational purposes only)

Depending on the severity of a violation of Article 6, Article 6-2, or this Article, the Company may take graduated measures such as warnings, deletion of inputs and outputs, restriction of the Service, and account suspension, and keeps a record of the measures taken.

Article 8 (Changes to Terms)

The Company may revise the Terms and will announce changed Terms through service notices. Matters that may significantly affect users will be separately notified through the service main screen. If users continue to use the Service after the effective date of changed Terms, even without agreeing to the changes, the Company will consider them to have agreed to the changed Terms.

Article 9 (Third-Party Services)

The Service may include content, products, and services provided by third parties. The Company has no control over third-party services and is not responsible for any damage or loss caused by the use of third-party services. The use of third-party services may be subject to their own terms of use and privacy policies.

Article 10 (Service Changes and Termination)

The Company may change or terminate the Service at any time. Unless separate terms are provided for service changes, these Terms apply. The Company may suspend the Service if users violate these Terms or if the Company or its partners decide to terminate service provision.

Article 11 (Disclaimer and Compensation)

The Service is provided 'as is' or 'as available' to the extent permitted by applicable law. The Company does not make any warranties regarding the Service, including merchantability, quality, fitness for a particular purpose, accuracy, virus-free, or non-infringement of third-party rights. The Company is not liable for any damages incurred by users while using the Service unless due to intentional or gross negligence.

Article 12 (Governing Law and Dispute Resolution)

These Terms are governed by the laws of the Republic of Korea. In the event of a dispute between the Company and users regarding the Service, jurisdiction shall be determined in accordance with the Korean Civil Procedure Act.
